An application filed on February 9, 2026 included an application data sheet naming each inventor, but no inventor's oath or declaration. The applicant received a notice to file missing parts and paid the surcharge. Under 37 CFR 1.53(f)(3), until when may the executed oath or declaration be postponed?
Answer: Until the date the issue fee is paid. If an application data sheet identifying each inventor by legal name is filed, the inventor's oath or declaration may be postponed until the application is otherwise in condition for allowance and must be filed no later than the date the issue fee is paid (37 CFR 1.53(f)(3); MPEP 602.01(a), 601.01(a)). Why not the others: - The first Office action: the postponement runs well past it. - Any reply: not the trigger. - Grant: it must be filed by issue fee payment, which is before grant. - 12 months after filing: no such period applies to the oath. Rule: With a proper ADS and the surcharge, the oath or declaration can wait until the issue fee is paid. Source: MPEP § 602.01(a) (9th ed., Rev. 01.2024); 37 CFR 1.53(f)(3); as at Oct 2026
